Affiliated Business Arrangement Disclosure

Federal law requires us to tell you when we refer you to a settlement service provider we have a financial interest in — and to tell you plainly that you do not have to use them.

This is to give you notice that Florida Flat Fee Brokers has a business relationship with Atlantic Title Firm, a Florida-licensed title insurance agency. The two companies are under common ownership. Because of this relationship, a referral to Atlantic Title Firm may provide Florida Flat Fee Brokers, or its owners, a financial or other benefit.

Set forth below is the estimated charge or range of charges for the settlement services described. You are NOT required to use Atlantic Title Firm as a condition of the purchase, sale or refinance of the subject property, or as a condition of any service we provide.

There are frequently other settlement service providers available with similar services. You are free to shop around to determine that you are receiving the best services and the best rate for these services.

Florida title insurance premiums are promulgated by the Florida Office of Insurance Regulation. Every licensed Florida title agency must charge the same premium for the same coverage, so the premium is not a point of price competition. Closing and settlement fees are not promulgated and do vary between agencies.

Acknowledgment. Where we refer you to Atlantic Title Firm, you will be given this disclosure in writing to sign and date at or before the time of the referral, and you will receive a copy for your records.

Why this notice exists

The Real Estate Settlement Procedures Act prohibits paying or receiving anything of value in exchange for referring settlement service business. There is a narrow exemption for arrangements between commonly owned companies — but only when three conditions are met: you are given this written disclosure at or before the referral, you are not required to use the affiliated provider, and the only thing of value received is a return on ownership.

We publish the disclosure here so it is available before you ever speak to us, in addition to giving it to you in writing at the point of referral.

What this means practically

Use whichever closing agent you prefer. If you already have one, tell us and we will work with them. If your buyer has a preference and the contract gives them the choice, that governs. Our fee to you does not change either way, and nothing in our service is conditioned on using an affiliated provider.
